Logement social : nouveau répit législatif

La loi relative à la solidarité et au renouvellement urbains du 13 décembre 2000, dite loi « SRU », oblige les communes les plus importantes à disposer d’un minimum de logements sociaux sur leur territoire, sous peine de devoir acquitter des pénalités financières. Initialement fixé à 20 %, ce taux de logements sociaux a été porté à 25 % par la loi « Duflot 1 » du 18 janvier 2013. Cette obligation concerne les communes de plus de 3 500 habitants (1 500 habitants en Ile-de-France) comprises dans une agglomération ou un établissement public de coopération intercommunale (EPCI) de plus de 50 000 habitants et comprenant au moins une commune de plus de 15 000 habitants. Or, la toute récente loi NOTRe redistribue entièrement la carte des intercommunalités en fixant désormais de nouveaux seuils de population. Aussi, afin de permettre aux communes concernées de pouvoir atteindre leurs objectifs en matière de réalisation de logements sociaux, le législateur a-t-il décidé d’exonérer de pénalité, durant trois ans, les villes concernées par la modification du périmètre de leur intercommunalité.
